Florida Foreclosure Timeline: What Sellers Can Still Do
A certified letter, a lis pendens on the county record, and a sale date that is closer than it looks.
Short answer: Florida foreclosure is a court process. After missed payments the lender files a lawsuit, records a lis pendens, and later sets a clerk sale. You can often still sell as-is for cash before that sale if title can pay off the loan. USA Capital Group LLC. Call (407) 470-0491 or use the sell form.
Tuesday we stood on a porch in Pine Hills with a stack of unopened envelopes on the washer. The owner had missed four payments. He still had the keys. He did not have a plan past "maybe they will wait." The lis pendens was already on the Orange County record. The sale date was not next week, but it was on a calendar.
USA Capital Group LLC buys files like that from 1707 Orlando Central Pkwy Ste 410. If you want to avoid foreclosure and sell a house in Florida, the clock is legal, not marketing. This is general information. It is not legal advice.
Florida is a judicial foreclosure state
The lender cannot just post a notice and take the house. They file a lawsuit in the county where the property sits. They record a lis pendens, which is public notice that the house is in a pending action. Then the court process runs: service, possible defaults, a judgment, and a clerk's sale. How long? It depends on the circuit, how fast papers get served, and whether anyone answers. Some files drag more than a year. Some move faster if nobody responds. Do not trust a national "90 day" graphic. Pull your case number on the clerk site and read the dates.
The stages sellers actually feel
Missed payments come first. Then collection calls and a notice of default from the servicer. Then a complaint. Then the lis pendens. Then a judgment. Then a sale date posted by the clerk. After the sale, if you still occupy the house, there can be a writ later. Each stage has a different amount of room to sell.
- Late and default: you can still catch up, modify, or sell if the numbers work.
- Lawsuit and lis pendens: title companies already see the case. A cash buyer prices the payoff plus the legal mess.
- Judgment: the debt is now a court number. Sale scheduling is next.
- Sale date: the window is short. If the clerk sells it, you do not control the deed anymore.
We have walked houses where the owner thought "foreclosure" meant the bank already owned it. It did not. They still held title. They also had a date on a clerk page they had never opened.
What you can still do before the sale
Reinstate if you can pay the arrears and fees the servicer quotes. Modify if the servicer actually offers one and you can live with the new payment. Short sale if the lender will take less than the payoff and you have time. Deed in lieu is a conversation with the lender, not a form we fill out for you.
Or sell. Listing a house that will not show, with a lis pendens on title, is a slow path for a clock that is already running. An as-is cash close is faster when the file fits. Typical seller close on a clean cash file is 7 to 21 days. A foreclosure file is rarely clean. Payoff letters, HOA, and the case all have to line up. See how a cash home sale works in Florida.
A cash offer does not stop a foreclosure by itself. Closing with a payoff and a dismissal (or a satisfied mortgage) is what stops it.
Selling as-is on a foreclosure clock
This is our lane. We buy tired houses in Orlando and across 19 counties. Roof, HVAC, tenants, clutter, code. No repair list. The offer subtracts repairs, hold, and a margin. The mortgage and the foreclosure costs still come off at the table. You walk with whatever equity is left, if any. Sometimes the number is small. Sometimes it is enough to start over without a sale on the courthouse steps.
If you inherited the house and it is also in default, you have two clocks. Title still needs the people who can sign. We already wrote that in inherited house options in Florida. People search "sell inherited house fast Orange County FL" and then find a lis pendens they did not know was there. Same kitchen. Extra paper.
As-is math is in what as-is actually covers.
The Pine Hills washer, without the myth
The owner wanted two more months "to get current." The servicer quote was more than he had. We walked it in twenty minutes. Offer that afternoon, subject to a payoff and title. He talked to a housing counselor the same week. He signed after he saw the clerk sale sitting on a Tuesday in November.
We did not "save" anyone with a slogan. We bought a tired house, paid the loan off at closing, and he kept a car and a security deposit for a rental. Not a movie. A file that still had a deed in his name.
Who this is for, and who needs a lawyer first
Read this if you are behind in Orange, Seminole, Osceola, Hillsborough, or another of the 19 counties we buy in, and you still have title. Cash as-is fits a clock: insurance, a payment, a sale date you can see.
Call a Florida foreclosure attorney or a HUD-approved counselor if you were not served, if you want to fight the case, or if you think the numbers are wrong. We buy houses. We do not represent you in court. List on the open market if the house shows well, you have months, and you can pay to keep the lights on while it sits.

Questions about the Florida foreclosure timeline
How long is the Florida foreclosure timeline?
Florida is a judicial foreclosure state. After missed payments, the lender files a lawsuit and records a lis pendens. Then come service, a judgment, and a clerk sale date. The whole clock is often many months, not days. Your file's dates are on the court docket, not on a national blog.
Can I still sell my house after a lis pendens in Florida?
Often yes, if you close before the clerk sale and title can clear the mortgage and the foreclosure case. USA Capital Group LLC buys as-is in Orange County and 18 other counties. The payoff and any junior liens still come off the settlement statement. We are not your foreclosure lawyer.
Can I sell an inherited house fast in Orange County FL if it is also in foreclosure?
Sometimes. You still need the people who can sign a deed, and title still needs the mortgage and the case to resolve at closing. An inherited house in Orange County FL with a lis pendens is two clocks, not one. Call (407) 470-0491 and we will say if the file fits.
What happens at a Florida foreclosure sale?
If nobody stops the case, the clerk auctions the property. You can lose the house and still owe a deficiency depending on the judgment. After the sale there is a short window that is easy to miss. Talk to a Florida attorney before that date.
