Code Violations, Open Permits, and Selling Anyway

A yellow door hanger from code does not mean you have to finish the punch list before you sell.

Short answer: You can sell a house with code violations in Orlando. Open permits and city liens ride with the file. USA Capital Group LLC prices that mess and closes at title. Call (407) 470-0491 or use the sell form.

Central Florida house exterior with tired siding, the kind of stock that often carries open permits

We walked a 3/2 off Mercy Drive because the owner had a stack of Orange County notices on the kitchen counter. Unpermitted rear room. Tall grass from last summer. A contractor who started a roof and never pulled the final. The owner thought she had to finish every item before anyone would buy.

She did not. A cash buyer can close through that file. USA Capital Group LLC buys houses with code violations as-is from 1707 Orlando Central Pkwy Ste 410. We still need access and a title search. We do not need you to become a general contractor first.

What a code violation actually is

Code is the city or county saying the house is out of line with local rules. Tall grass. Boarded windows. An addition with no permit. A pool with no fence. It is not a criminal case by itself. It is a file that can grow into daily fines and a recorded lien if you ignore it.

Orlando and unincorporated Orange County keep separate systems. Kissimmee and Osceola have their own. Tampa Bay cities do too. We buy in 19 counties. The paperwork looks different. The seller problem is the same: you cannot list your way out of a lien that title will see.

We are not the city. We cannot "clear" a case with a phone call. We can buy the house, then we own the case. That is the trade.

Open permits vs code liens

An open permit means someone started work and never closed it. A roof, a water heater, an electrical panel. The inspector never signed the card. Title companies ask about those because the next owner inherits the unfinished job.

A code lien is money. Fines stacked, then recorded against the land. At closing, title will want a payoff letter from the city or county. Sometimes the amount is small. Sometimes it is ugly because nobody answered mail for two years.

Do not guess the balance. Ask the clerk or code office for a written amount. We will too. If you already have the letter, send it with the address.

Why a listing stalls on this file

Financed buyers need an appraiser and an inspector. An open addition and a roof with no final are the kind of items that kill a loan. The listing sits. You keep mowing, or you stop mowing and the next notice arrives.

Agents also get stuck on "who pulls the permit." You, the buyer, or nobody until after close. Retail contracts fight over that. Our cash contract assumes we take the house as-is, including the open items, unless title cannot insure the deed.

If the house is also tired, that is a second problem on the same walkthrough. We already wrote what as-is covers when we buy in Orlando.

A Mercy Drive kitchen counter full of notices

The owner had started a porch with a friend. No permit. Then code tagged the grass. Then the AC died and she stopped living there. Vacant plus code is a bad mix. Holding costs keep running. We covered that clock in holding costs on a vacant Central Florida house.

We wrote a number that assumed we would finish or demo the porch after we owned it, and that title would collect the known lien at closing. She did not have to hire anyone. She did not have to go to a hearing. She signed. We closed at a title company. That is the whole pitch: sell the problem with the house.

How we price the mess

We look at sold comps, then we subtract repairs, hold, and the known city bill. ARV is the after-repair value: what a finished house on that street can sell for. Hold is insurance, utilities, and time while we work. If the lien is unknown, we pad. If you hide a notice, we will find it in title and the number moves.

Bring what you have: photos, the latest letter, the permit number if you know it. A 20-minute walk beats a week of email. Typical close is 7 to 21 days if title can insure.

Who this is for, and who should still list

This path fits if code is already on the door, a contractor vanished, an addition never got a final, or you inherited a house and found the file in a drawer. It fits if you are done arguing with a city portal.

List if the violation is a one-item grass notice, the house shows, and you can wait for a retail buyer. A small, current case is not the same as a two-year lien. We would rather lose a clean file than pretend a listed loan will close over an unpermitted addition.

We buy across Central Florida and Tampa Bay from the Orlando office. Send the address and the notice. If there is no notice, say what you think is unpermitted.

Questions about selling with code violations

Can I sell a house with code violations in Orlando?

Yes. A cash buyer can close with open cases. Title will look for recorded liens and collect payoffs. You do not have to finish every repair first if the buyer takes the house as-is.

Do open permits have to be closed before closing?

Not always. Some files close with the permit still open and the buyer takes the work. Title and the city still have to allow the transfer. We price that risk instead of making you hire a contractor this week.

What happens to a city or county code lien at closing?

A recorded lien shows on the title search. The closing agent requests a payoff and pays it from proceeds, the same way a mortgage payoff works. If there is no equity after the lien, we talk before anyone signs.

Can I sell an inherited house in Orange County if code tagged it?

Often yes, once title can close. Inherited house files stall when nobody wants to pull permits. We buy many of those as-is. Access for a walkthrough still has to happen.

Who should still list a house with a code case?

List if the case is small, the house shows well, and a retail buyer can get a loan. If the addition is unpermitted or fines have stacked, a cash investor is usually cleaner.
